I would disagree with that too, but don't think he was quite that close.
If someone standing across the street shouts "I'm going to kill you", I'm
not going to pull arms and drop him dead. I'd be on my guard, but would opt
to inform the police instead.
If he goes through with any motions that imply he intends to carry out the
threat, and has any probability of succeeding... he's in trouble. I still
might opt to wound/immobilize, rather than kill, but that depends on lots of
unknown circumstances.
I didn't see any conflict between the original statement and this view.
I did find some of both sides of this exchange quite hilarious though, so
I'm glad it went there. :)
