Legal Update: Patent Law

The Supreme Court Releases Bilski: Business Methods May Still Be Patentable;
The Machine or Transformation Test Survives, But Is Not The Sole Test For
Patentability

By Johnathan Mansfield, Intellectual Property Group Shareholder, Schwabe,
Williamson & Wyatt

In what may be the most anticipated patent decision in decades, the U.S.
Supreme Court has just delivered its opinion in Bilski v. Kappos. The full
opinion can be found here:
http://www.supremecourt.gov/opinions/09pdf/08-964.pdf. Although the full import
of Bilski will be debated for some time, it is clear that business method
patents, which many thought would be outlawed by the Supreme Court, are not
categorically excluded from patent eligibility

If you have questions about Bilski or how it may affect your business, contact
your Schwabe IP attorney for details.
