I read the statute very differently.
David Boies (chief prosecutor in the Microsoft case and Napster chief
legal council) agrees with me. His primary argument in the Napster case
is that ALL non-commercial copying is legal. This argument is probably
the main reason Napster was bought out and the case will never make it
to trial.
