Wow, sounds like a disfunctional relationship.  I'd pull his line.  It's not 
the programatic answer you're looking for, but is completely un-bypassable.

What's his interface to your modem--serial port?  nic?  Either should be 
easy enough to make disappear if shear reason fails.
