Sorry Brian, that is not at all correct, no matter how you attempt to
twist the language the fact remains that to avoid is to not extend
consideration. The only saving grace is that the language in the bill
does stipulate that communication to entities outside of state control
is "unauthorized". The very fact that MS does disclose that their
operating system does communicate like this, and you agree to this by
using the product, then it might be construed as "authorization" and
therefor not subject to these mandates. This is, at least, as sketchy as
confusing "avoid" with "not preferred".
