On GSM phones the activiation is tied to the sim card in the phone. It is
possible to use a non-approved unlocked gsm phone by moving the sim chip to
the other phone.
I had a coworker who used a Motorola E680i phone he picked up overseas
(since they aren't available in the US) and to use it here he set up a
cingular account with the cheap free phone and moved the chip over to the
E680i and threw away the free phone. It worked great.
Actually, I kind of wonder if the new phones show up in GSM first because
early adopters can buy and use them without the cell companies knowing what
phone they are using.
